1. Agreement to Terms

By accessing or using Interiorly AI ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you do not have permission to access the Service.

2. Description of Service

Interiorly AI provides an AI-powered interior design service that allows users to:

• Upload images of rooms or interior spaces
• Generate AI-designed interior transformations using advanced Flux models
• Choose from multiple design styles (modern, traditional, minimalist, etc.)
• Download and share generated designs
• Purchase credits to access design generation services

3. User Accounts

3.1 Account Creation

To use our Service, you must create an account through Clerk authentication. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information
• Keep your password secure and confidential
• Be responsible for all activities under your account
• Notify us immediately of any unauthorized access

3.2 Account Eligibility

You must be at least 13 years old to use the Service. Users under 18 must have parental or guardian consent.

4. Credits and Pricing

4.1 Credit System

Our Service operates on a credit-based system:

• New Users: Receive 5 free credits upon registration (3 base + 2 bonus)
• Credit Usage: Each AI design generation consumes 1 credit
• Credit Packages: 10 credits ($7.99), 25 credits ($14.99), 150 credits ($49.99)
• Non-Transferable: Credits are non-transferable and non-refundable
• No Expiration: Purchased credits do not expire

4.2 Payments

Payments are processed securely through Dodo Payments. By making a purchase, you agree to:

• Provide valid payment information
• Pay all charges incurred under your account
• Accept that all sales are final unless otherwise required by law
• Understand that prices may change with notice

4.3 Refund Policy

Due to the nature of digital services, credits are generally non-refundable. Refunds may be considered in exceptional circumstances, such as:

• Service technical failures preventing credit usage
• Duplicate charges or billing errors
• Unauthorized transactions (reported within 48 hours)

5. Storage Usage and Limits

To ensure service sustainability and fair resource allocation, we implement storage limits based on your credit tier:

5.2 Automatic Storage Management

To maintain storage limits:

• Automatic Cleanup: When you reach your storage limit, the oldest non-favorite images are automatically removed to make space for new generations
• Expiration Enforcement: Images past their expiration date are automatically deleted from storage daily
• Pre-Generation Checks: Before generating new images, the system verifies storage availability
• Grace Period: You receive warnings before images expire or are removed

5.3 Favorite Images

You can protect important images by marking them as favorites:

• Permanent Storage: Favorite images never expire, regardless of tier
• Exemption from Limits: Favorites don't count toward your tier's storage limit
• Priority Protection: Only non-favorite images are removed during automatic cleanup
• Unlimited Favorites: No limit on how many images you can favorite

5.4 Tier Upgrades and Downgrades

Your storage tier is determined by your total credits (lifetime accumulated):

• Automatic Upgrades: Tier automatically upgrades when you purchase credits that push you to the next threshold
• Immediate Benefits: New storage limits and retention periods apply immediately
• No Downgrades: Your tier never decreases, even if you use all your credits
• Future Images: Newly generated images receive the retention period of your current tier
• Existing Images: Previously generated images keep their original expiration date

5.5 User Responsibilities

You are responsible for:

• Downloading images you want to keep permanently before expiration
• Marking important images as favorites to prevent auto-deletion
• Monitoring your storage usage via the dashboard
• Understanding that deleted images cannot be recovered
• Upgrading to higher tiers if you need more storage or longer retention

5.6 Service Cost Management

These storage limits exist to:

• Control Firebase Storage costs and keep pricing affordable
• Ensure fair resource distribution among all users
• Maintain service sustainability and reliability
• Prevent abuse or excessive storage consumption

We reserve the right to modify storage limits with reasonable notice to ensure service viability.

6. Acceptable Use Policy

5.1 Permitted Use

You may use the Service for:

• Personal interior design inspiration and planning
• Professional design projects (with appropriate credit packages)
• Commercial use of generated designs (with Pro package)

5.2 Prohibited Activities

You agree NOT to:

• Upload illegal, offensive, or inappropriate content
• Upload images containing people without consent
• Attempt to reverse-engineer or replicate our AI models
• Use automated systems (bots) to generate designs
• Resell or redistribute generated designs without proper licensing
• Share account credentials with others
• Abuse, harass, or harm other users or our staff
• Engage in fraudulent activity or payment manipulation

7. Intellectual Property Rights

6.1 Your Content

You retain ownership of images you upload. By uploading content, you grant us a limited license to process, store, and display your images for the purpose of providing the Service.

6.2 Generated Designs

For generated AI designs:

• Personal Use: You own generated designs for personal, non-commercial use
• Commercial Use: Pro package holders may use designs for commercial projects
• Attribution: Attribution to Interiorly AI is appreciated but not required
• AI Disclosure: You should disclose AI-generation when presenting designs professionally

6.3 Our Platform

The Service, including its software, algorithms, design, and branding, is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute any part of our platform without permission.

8. AI-Generated Content Disclaimer

Our Service uses artificial intelligence models for design generation. You acknowledge that:

• AI-generated designs are computational approximations and may not be architecturally feasible
• Designs should not replace professional architectural or interior design consultation
• Generated designs are for inspirational and planning purposes
• We do not guarantee specific results or design quality
• Generation times may vary based on server load (typically 20-60 seconds)

9. Service Availability and Modifications

We reserve the right to:

• Modify, suspend, or discontinue the Service at any time
• Update pricing, credit costs, and service features
• Perform maintenance that may temporarily interrupt service
• Change or remove design styles and AI models

We will provide reasonable notice of significant changes when possible.

10. Limitation of Liability

To the maximum extent permitted by law:

• The Service is provided "AS IS" without warranties of any kind
• We are not liable for any indirect, incidental, or consequential damages
• Our total liability shall not exceed the amount you paid in the past 12 months
• We are not responsible for decisions made based on AI-generated designs
• We are not liable for third-party service failures (payment processors, AI providers, etc.)

11. Indemnification

You agree to indemnify and hold harmless Interiorly AI and its affiliates from any claims, damages, or expenses arising from:

• Your violation of these Terms
• Your use of the Service
• Content you upload to the Service
• Your infringement of any third-party rights

12. Account Termination

11.1 By You

You may delete your account at any time. Upon deletion, your personal data will be removed in accordance with our Privacy Policy. Unused credits are forfeited upon account deletion.

11.2 By Us

We may suspend or terminate your account if you:

• Violate these Terms of Service
• Engage in fraudulent or abusive behavior
• Fail to pay for services
• Remain inactive for an extended period

13. Dispute Resolution

12.1 Governing Law

These Terms are governed by the laws of [Your Jurisdiction], without regard to conflict of law principles.

12.2 Arbitration

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration, except where prohibited by law.

15. Changes to Terms

We may update these Terms from time to time. Material changes will be notified via email or prominent notice on the Service. Your continued use after changes constitutes acceptance of the updated Terms.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Interiorly AI regarding the Service.
